Hammerite End User Licence Agreement
Version 1.0 - Copyright © 2024-2026 Misukatti Interactive. All rights reserved.
This agreement is between Misukatti Interactive ("the Licensor") and you, the individual or the legal entity that bought a licence to one or more of the Hammerite addons ("the Licensee"). Buying, downloading, installing or using the Software means you accept it. If you do not accept it, do not use the Software.
1. The Software
"The Software" is each Hammerite addon you bought a licence to - hammerite-core,
hammerite-editor, hammerite-audio, hammerite-nav - with its source code, documentation,
examples and updates the Licensor provides for it. A licence covers the addons you bought, and no
others.
"A Product" is a game or other interactive application you make, and "an End User" is anyone who obtains a copy of a Product.
2. What you may do
The Licensor grants the Licensee a worldwide, non-exclusive, non-transferable, perpetual licence to:
- use, study and modify the Software to make Products, by the Licensee and by its employees and contractors working on the Licensee's Products;
- include the Software, modified or not, in Products, and distribute and sell those Products, without paying the Licensor any royalty; and
- include the Software in a Product so that its End Users can make and share content for it - maps, mods, levels - using the Software as part of that Product. End Users need no licence of their own to do so.
3. What you may not do
- Distribute, sell, sublicense, rent or lend the Software, or any part of it, other than as part of a Product under section 2.
- Offer the Software, modified or not, on its own or as part of a tool, template, framework or asset for other developers - in an asset store or anywhere else - whether for payment or not.
- Give End Users the Software in a way that lets them use it apart from the Product, such as exporting it as a standalone editor or packaging it as an addon of its own.
- Remove or alter the Software's copyright notices, or those of the third-party components in it.
- Transfer this licence to anyone else without the Licensor's written consent.
4. Third-party components
The Software includes components under their own licences, which apply to those components and
take precedence over this agreement for them. Notably, the Inter typeface (hammerite-core/inter.ttf)
is under the SIL Open Font License 1.1, in hammerite-core/inter-OFL.txt.
5. Ownership
The Software is licensed, not sold. The Licensor keeps all rights, title and interest in the Software that this agreement does not expressly grant. The Licensee owns its Products and the content made with the Software, but not the Software within them.
6. Updates and support
The Licensor may provide updates, and is not obliged to. Updates are covered by this agreement unless they come with their own. Support, if any, is as described where the Software is sold.
7. No warranty
The Software is provided "as is", without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
8. Limitation of liability
To the extent the law allows, the Licensor is not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the use of or inability to use the Software. The Licensor's total liability under this agreement is limited to the amount the Licensee paid for the licence.
9. Termination
This licence ends automatically if the Licensee breaks it. The Licensee must then stop using the Software and delete its copies, but may keep distributing Products released before it ended. Sections 5, 7, 8 and 10 survive termination.
10. Governing law
This agreement is governed by the laws of Finland, without regard to its conflict-of-law rules. Disputes are settled by the courts of Finland, except where the law of the Licensee's country of residence gives a consumer the right to bring proceedings there.
11. Entire agreement
This is the whole agreement between the Licensor and the Licensee about the Software. If a part of it is found unenforceable, the rest remains in force. Terms of the store the Software was bought through apply alongside this agreement; where they conflict, this agreement prevails to the extent that store allows.
